Liability Release Agreement

Limited Liability: Except as expressly provided in this agreement, Moon Creek Crystals makes no guarantees or warranties, expressed or implied. In no event will Moon Creek Crystals be liable to the Participant for consequential or special damages. Notwithstanding any damages that the Participant may incur, Moon Creek Crystals' entire liability under this agreement, and the Participant's exclusive remedy, will be limited to the amount paid by the Participant to Moon Creek Crystals under this agreement for all services rendered up until program end date.

This is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior and written oral representations.

If a dispute arises out of this agreement that cannot be resolved by mutual consent, the Participant and Moon Creek Crystals agree to attempt to mediate in good faith for up to 90 days after notice given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney's fees and costs from the other party.

Applicable Law: This contract shall be governed by the laws of the State of California in Sonoma County and any applicable federal law.
